For children participating in ECI programs assisted under IDEA Part C, and who will participate in preschool programs assisted under IDEA Part B, the ECI and the LEA are responsible for ensuring a smooth and effective transition to those preschool programs. 300.124(a)1412(a)(9)The ECI lead agency must notify the LEA for that the child will shortly reach the age of eligibility for preschool services under IDEA Part B; and, In the case of a child who may be eligible for such preschool services 1437(a)(9)(A)(ii)
The LEA must ensure that an IEP be in effect for eligible children with disabilities on their third birthday in compliance with the ARD committee frameworks. 300.101(b)89.1035(a), If a child's third birthday occurs during the summer, the child's ARD committee must determine the date when services will begin. The ARD committee must comply with the LRE framework. Home instruction may be used for young children (ages three through five) when determined appropriate by the ARD committee. 89.63(c)(2)(B)
What We Do Three is Three: Services for students with disabilities begin on the third birthday except for children who are blind, visually impaired, or deaf. The student must be enrolled in public school on their third birthday. Campuses and ARD/IEP meeting/IEP committees with programs for preschool students with disabilities (PPCD) must ensure that all children referred are enrolled on or by this time to ensure FAPE.
Parent/Guardian: School personnel assist the parent/guardian in initiation and completion of the referral process. Parents may refer at every school site, even if the school does not have a special education Preschool Program for Children with Disabilities (PPCD). As a requirement of federal law and Child Find procedures, it is the responsibility of the school staff to complete the referral data at the time the parent comes to the campus. The completed referral information is forwarded immediately to the campus evaluation specialist.
Hospital/Physical/Medical Community: After notification by the medical community, the campus contact must notify the campus evaluation specialist immediately. The evaluation specialist at the student’s home school must contact the parent and assist in the initiation and completion of the referral process.
